Treating Customers Fairly - a debate

Would a case based on 'TCF' stand up to the scutiny of the Tribunal or courts?
By December 2008 the FSA expects firms to have appropriate management information or measures in place to test - and demonstrate - that they are consistently treating their customers fairly.
These requirements are set against the broad TCF Outcomes which themselves emanate from the FSA's Principles for Businesses. Principle 6 requires firms to 'pay due regard to the interests of its customers and treat them fairly'. It is likely that many firms will miss this deadline.
Join a FSLA debate on the shape (and likelihood) of possible enforcement action by the FSA based on TCF.
